Terms of Service

1. Acceptance of Terms

By accessing or using Café Rika ("the Bot"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Bot. We reserve the right to modify these Terms at any time without prior notice. Your continued use of the Bot constitutes acceptance of any changes.

2. Description of Service

Café Rika is a Discord bot that provides various features including but not limited to:

• Server moderation tools
• Welcome messages and member management
• Music playback functionality
• Custom commands and automation
• Server management dashboard

3. User Obligations and Prohibited Conduct

By using the Bot, you agree not to:

• Use the Bot for any illegal or unauthorized purpose
• Violate Discord's Terms of Service or Community Guidelines
• Attempt to gain unauthorized access to the Bot's systems or networks
• Reverse engineer, decompile, or disassemble any aspect of the Bot
• Use the Bot to harass, abuse, or harm other users
• Spam, flood, or abuse the Bot's features
• Distribute malware, viruses, or harmful code through the Bot
• Impersonate others or misrepresent your affiliation with any person or entity
• Use automated systems or bots to interact with the Bot without permission

4. Intellectual Property Rights

All content, features, and functionality of the Bot, including but not limited to text, graphics, logos, icons, images, audio clips, and software, are the exclusive property of Café Rika and are protected by international copyright, trademark, and other intellectual property laws. The Rika character and associated artwork are the property of their respective owners. You may not use, copy, reproduce, modify, or distribute any content from the Bot without explicit written permission.

5. Disclaimer of Warranties

THE BOT IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement
• Warranties that the Bot will be uninterrupted, error-free, or secure
• Warranties regarding the accuracy, reliability, or completeness of any content
• Warranties that defects will be corrected

You acknowledge that your use of the Bot is at your sole risk.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CAFÉ RIKA AND ITS OWNERS, OPERATORS, DEVELOPERS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, data, use, goodwill, or other intangible losses
• Damages resulting from unauthorized access to or alteration of your data
• Damages resulting from any conduct or content of third parties using the Bot
• Damages for service interruption, deletion of files, or errors
• Any damages arising from your use or inability to use the Bot

Our total liability to you for all claims arising from or related to the Bot shall not exceed $100 USD or the amount you paid us (if any) in the 12 months before the claim arose, whichever is less.

7. Indemnification

You agree to defend, indemnify, and hold harmless Café Rika, its owners, operators, developers, affiliates, and their respective officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or expenses (including attorney's fees) arising from: (a) your use of the Bot; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you submit, post, or transmit through the Bot.

8. Termination

We reserve the right to suspend or terminate your access to the Bot at any time, for any reason, without notice or liability. This includes but is not limited to violations of these Terms, fraudulent activity, or conduct that we determine to be harmful to other users, the Bot, or third parties. Upon termination, your right to use the Bot will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

9. Third-Party Services

The Bot may integrate with or provide access to third-party services, websites, or content (including Discord). We do not control and are not responsible for any third-party services. Your use of third-party services is at your own risk and subject to their respective terms and policies. We make no warranties regarding third-party services and disclaim all liability arising from your use of them.

10. Data and Content

You retain all rights to any content you submit through the Bot. However, by submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and process such content solely for the purpose of providing and improving the Bot's services. We are not responsible for the security, integrity, or confidentiality of any content transmitted through the Bot. You are solely responsible for backing up your data.

11. Age Requirements

The Bot is intended for users who meet Discord's minimum age requirement (13 years or older, or older depending on your jurisdiction). By using the Bot, you represent and warrant that you meet these age requirements. If we become aware that a user does not meet the age requirements, we will terminate their access to the Bot.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of your jurisdiction, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Bot shall be resolved through binding arbitration in accordance with the rules of the applicable arbitration association, rather than in court. You waive any right to participate in class-action lawsuits or class-wide arbitration.

Notwithstanding the foregoing, we may seek injunctive or other equitable relief in any court of competent jurisdiction to protect our intellectual property rights or prevent unauthorized use of the Bot.

13. Changes to Service

We reserve the right to modify, suspend, or discontinue the Bot (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Bot. We may also impose limits on certain features or restrict access to parts or all of the Bot without notice or liability.

14. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Café Rika regarding the Bot and supersede all prior agreements and understandings, whether written or oral, relating to the subject matter herein.
